Qualifying for Social Security Disability Benefits

  • Social Security Disability Insurance (SSDI) benefits are available for disabled individuals and their dependants who have paid sufficient Social Security wage taxes and have acquired Social Security insured status.
  • Supplemental Security Income (SSI) benefits are different. They are available for disabled people who have never worked or have not paid sufficient Social Security taxes to qualify for SSDI benefits. To qualify for SSI, a person must also have low income and low assets.
  • In some cases an individual may apply for and qualify for both types of benefits.

Our attorneys provide skilled legal representation throughout the application process. We guide clients as they prepare the initial application and help them overcome obstacles along the way. If benefits are denied, we represent clients through all stages of the appeals process.

Working with an experienced disability benefits lawyer

While it may seem prudent to file your application without an attorney, you may lose time and risk losing benefits. Our attorneys know exactly what documentation will be necessary and can file your application correctly the first time so that you do not have to wait longer than is necessary to collect the benefits you are entitled to. We have the resources and experience necessary to help applicants avoid mistakes that might undermine a benefits application.

Seek medical advice as soon as possible and follow through with treatment

If you are considering applying, or even if you have already submitted an application, it is critical to get the medical treatment you need. If you do not tell your doctor about a health concern, your chances of getting better and qualifying for benefits are very slim. The Social Security Administration is very unlikely to approve an application without appropriate medical documentation.
