To protect your interests, apply as soon as you can
You should apply for disability benefits as soon as you become disabled. Although you do not need the assistance of a lawyer to apply for Social Security Disability benefits, this assistance can prove invaluable.
The application process is time-consuming and complicated, and it is easy for one or two simple mistakes to have serious consequences. Working with an experienced and knowledgeable attorney can help you avoid these mistakes, and may even help you secure benefits more quickly.
Additionally, an experienced lawyer can advise you of the relevant criteria, and help you understand the likely outcome of your benefits application. We can intervene early on in the process, giving you a realistic assessment of your chances of qualifying for benefits before you even begin the application.
There are financial and disability requirements
Financial - To be eligible for SSD benefits (not necessarily so for SSI), you must have made sufficient contributions to the system and have worked recently enough to still be insured. For example, if you stopped working many years ago but only recently became disabled, you may not be "insured" and may not be financially eligible.
Disability - To be considered disabled, a doctor must verify that you have a medical impairment that has lasted or is expected to last at least 12 months or is likely to result in death. You must demonstrate that your disability prevents you from performing the types of work you have done in the last 15 years. You may also have to prove that you are unable to perform easier, less demanding types of work.
Even if you do not quality for Social Security Disability Benefits based on the financial criteria, you may be eligible for Supplemental Security Income benefits. We also guide people through the application process for these benefits.
