Learning Disorders

Learning disorders have a negative impact on the brain's ability to receive, process, or retain information. This type of disability may prevent a person from achieving academic goals and may impact a person's skill in reading, writing, math, motor planning and listening. They are typically diagnosed through intelligence testing, academic tests, classroom performance and social interactions. They are usually diagnosed in childhood, although adults are occasionally diagnosed with this disability.

Mental Retardation

This condition is diagnosed before the age of 18. A diagnosis may be based on the results of an IQ test, or through observed difficulties of daily living, communication and socialization. The functional ability of a mentally handicapped person can vary, from borderline retardation to being profoundly impaired.

Qualifying for Benefits

Although learning disorders and mental retardation are two distinct forms of disability, the Social Security Administration (SSA) will use many of the same qualifiers when determining whether a person qualifies for Social Security Disability (SSD) or Supplemental Security Income (SSI), including:

  • The nature and extent of the disability
  • How the disability restricts the ability to carry out daily tasks
  • The ability to maintain social functioning
  • The ability to maintain concentration or pace in a work or school environment
  • The ability to make work or school related judgments
  • The ability to adapt to change in a work or school environment
  • The ability to handle work or school pressures

In every case, having proper medical documentation is key to getting approved for benefits. Our Philadelphia disability attorneys will walk you through the application process to ensure that it is done right the first time. The lawyers at the Disability Benefits Law Center, P.C., can also handle appeals if your application has been denied.
