For help with your Social Security appeals
Initial denials are common. Do not quit and do not lose hope. Our attorneys have helped thousands of disabled individuals obtain SSD and SSI benefits. If your claim is denied, you can take important steps by filing a timely appeal and seeking help from an experienced attorney.
Representation at the ALJ hearing
The ALJ hearing is often the best chance for success for people seeking SSD and SSI benefits. We exhaustively prepare our clients and ourselves for these hearings. In some cases we can avoid a hearing by filing a legal brief in support of a decision on the record.
Appeals Council review
If the decision from the ALJ is not favorable, you can request a review by the Social Security Appeals Council. Our lawyers are highly skilled in advocacy at this level.
Federal Court review
Individuals whose claims are denied by the Appeals Council may seek further review in federal court. We aggressively represent our clients at this level. Not all attorneys will handle your federal court appeal.
How is Pennsylvania different?
In Pennsylvania, claimants who are denied SSD or SSI benefits at the state agency (initial) determination can request an administrative hearing before an Administrative Law Judge (ALJ) without having to request "reconsideration" from the state agency. Claimants in New Jersey, Delaware and most other states are currently required to request Social Security Disability (SSD) or Supplemental Security Income (SSI) "reconsideration" from the state agency.
